EU SUP Directive
EU SUP Directive is Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment — the “Single-Use Plastics Directive”. It bans listed plastic items, requires marking, and mandates EPR. Palm leaf plates are non-plastic and sit outside the SUP scope. Bagasse and PLA are subject to specific scrutiny in the 2026 review of the directive.
In B2B context
The EU SUP Directive frames the entire EU eco-disposable conversation. It bans listed single-use plastic items (cotton bud sticks, cutlery, plates, straws, beverage stirrers, balloon sticks, expanded polystyrene food containers and beverage cups) and introduces extended-producer responsibility for plastic packaging. Palm leaf plates are unambiguously outside scope: they are not plastic by composition, do not contain plastic coatings, and are not subject to Articles 5 or 6 of the directive.
Bagasse and PLA face directive ambiguity. PLA, while bio-based, was assessed by the European Commission as a polymer and treated as plastic in member-state implementations. Bagasse plates frequently carry PFAS coatings or melamine binders that complicate their position. The 2026 directive review explicitly examined whether bio-based polymers should be re-classified — a determination with direct B2B import implications. Importers should consult the Regulatory Tracker for current EU member-state implementations.
